The Website may be used only for lawful purposes by individuals seeking employment and career information ("Candidates"), and by employers ("Employers") and executive search, recruitment and temporary help agencies ("Recruiters") seeking employees. You agree to use the Website only to send Content and receive Materials that are proper and related to purpose of the Website.

Subject to these Terms, Jobhawk grants you a non-exclusive, non-transferable, limited right to access, use and view this Website and the Materials thereon, solely for your own personal or internal company use, provided, however, that you may not, nor may you allow others to, directly or indirectly:

  1. use this Website in any manner that could damage, disable, overburden or impair this Website,
  2. interfere with the security of, or otherwise abuse this Website or any services, system resources, accounts, servers or networks connected to or accessible through this Website or affiliated or linked sites,

  5. post sexually explicit images or statements;
  6. post Content that is copyrighted, unless you are the copyright owner or have permission of the copyright owner to post it;

  9. impersonate any person or entity, including without limitation a Jobhawk employee or agent, an authorized user of Jobhawk' Services, a Candidate, an Employer or a Recruiter, or otherwise misrepresent your affiliation with any person or entity;
  10. post opinions, notices or advertisements, commercial or otherwise, or solicit business from Recruiters or Employers who post on the Website, including any solicitation by any of our competitors of Recruiters or Employers who post on the Website.

In addition, you agree that you are solely responsible for actions and communications undertaken or transmitted in the course of your usage of this Website, and that you will comply with all laws that apply or may apply to your use of or activities on this Website or in respect of the Content and Materials. Jobhawk will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.


User Information
When you register for the Website you will be asked to provide Jobhawk with information including a valid e-mail address. In addition to the terms that may be set forth in the Privacy Policy on this Website, you understand and agree that Jobhawk may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. Jobhawk will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.

Jobhawk reserves the right at all times to disclose any Content provided by you as necessary to satisfy any law, regulation or governmental request, or to edit, refuse to post or remove any Content, in whole or in part, that in Jobhawk's sole discretion is objectionable or in violation of these Terms.

Username and Password
You are responsible for maintaining the confidentiality of your username, password and registration information.     This Website acts as a venue, among other things, for Recruiters and Employers to post job opportunities and for Candidates to post résumés.

    Jobhawk does not screen or censor the listings offered and is not involved in the actual transaction between Candidates and Employers or Recruiters. As a result, Jobhawk has no control over the quality, safety or legality of the jobs or résumés posted, the truth or accuracy of the listings, the ability of Recruiters or Employers to offer job opportunities to Candidates, or the ability of Candidates to fill job openings. In addition, there may be risks, including, but not limited to, the risk of physical harm of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Website.

The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Canada and is independent of either party.

    Notwithstanding the foregoing, each party may pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.


    General
